What are the eligibility criteria for obtaining FCRA Registration?

The Foreign Contribution Regulation Act, 2010 (FCRA) regulates the acceptance and utilization of foreign contribution by certain individuals or associations. It is a central legislation that was enacted with the objective of preventing the use of foreign contribution for any activities detrimental to the national interest.

Under the FCRA, all associations which desire to receive foreign contribution are required to obtain prior registration or prior permission from the Central Government. The registration is valid for a period of 5 years and can be further renewed after 5 years.

The FCRA registration is a simple and straightforward process. In this article, we will look at the eligibility criteria for obtaining FCRA registration, the FCRA registration fees, and the FCRA registration process.

What is FCRA registration?

The Foreign Contribution Regulation Act or FCRA is a set of regulations that govern the receiving and utilization of foreign contributions by religious, educational, charitable, or social organizations in India. In order to receive foreign contributions, organizations must obtain FCRA registration from the Ministry of Home Affairs (MHA).

Once registered, organizations can receive foreign contributions from individuals, foreign governments, and foreign-based foundations and trusts. The FCRA regulates the utilization of these funds and requires that they be used for the purpose for which they were received.

Who is eligible for FCRA registration?

All entities which are registered under FCRA are required to maintain accounts and get them audited by a chartered accountant. They are also required to submit an annual report to the Ministry of Home Affairs.

In order to be eligible for FCRA registration, an organization must:

  1. be registered as a society under the Societies Registration Act, 1860;
  2. be a public trust registered under any law for the time being in force;
  3. be a Section 8 Company; or
  4. be an association or institution recognized by the Central Government.

Furthermore, the organization must also be engaged in certain approved activities. These activities are listed in the section 16 of the FCRA.
